Welcome to Dead Cute Studio (deadcutestudio.com). These Terms and Conditions (“Terms”) govern your use of our Site and any purchase you make from us. By using the Site or placing an order, you agree to these Terms.
1. About Us
Dead Cute Studio is a print-on-demand apparel brand based in British Columbia, Canada. Our products are printed to order through our fulfillment partner and shipped directly to you.
2. Products and Pricing
- All prices are listed in Canadian dollars (CAD) unless otherwise noted, and are subject to change without notice.
- We run limited drops — once a design/size/color combination sells out, it may not be restocked.
- We make reasonable efforts to display products, colors, and sizing accurately, but slight variations may occur due to printing processes and display settings.
3. Orders
- Placing an order through the Site constitutes an offer to purchase, which we may accept or decline.
- We reserve the right to cancel or refuse any order, including in cases of suspected fraud, pricing errors, or inventory issues, and will notify you and issue a refund if this happens.
- Please double-check your size, color, and shipping address before completing checkout. Because every item is printed to order, orders cannot be changed or cancelled once placed — this includes the wrong size, wrong color, or a change of mind. 4. Payment
- Payment is processed securely through our third-party payment processor at the time of order.
- We do not store your full payment card details on our own systems — that information is handled directly by our payment processor.
5. Shipping
- All orders, regardless of destination, are fulfilled via our print partner’s China Special Line.
- Because items are printed to order, production takes 3–7 business days. All orders — every destination we ship to, with no separate or faster line for the US — ship from China via our print partner’s Special Line: 10 business days on average once shipped, delivered within 15 business days 95% of the time. Estimated shipping rates by destination are provided at checkout. See our Shipping page for full details, which governs in the event of any conflict with this summary.
- We are not responsible for delays caused by shipping carriers, customs, or other circumstances outside our control.
6. Guarantees
We stand behind the quality of what we make. If your order arrives with a printing error, damage from transit, a manufacturing defect, or is the wrong item entirely, we guarantee a free replacement — contact us within 14 days of delivery with a photo of the issue. Full details are on our Returns & Exchanges page.
This guarantee does not extend to sizing issues or a change of mind, since each item is custom-printed to order — see Section 7 below and our Returns & Exchanges page for what is and isn’t covered.
7. Returns and Exchanges
Because items are printed to order, we’re not able to accept returns or exchanges for sizing issues or a change of mind. If your order arrives wrong, damaged, defective, or misprinted, we’ll make it right with a free replacement — contact us within 14 days of delivery with a photo of the issue. 8. Intellectual Property
All designs, artwork, logos, the “Mr. Stitches” character, and site content are the property of Dead Cute Studio and may not be copied, reproduced, or used without our written permission.
9. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose
- Attempt to interfere with the Site’s security or functionality
- Use automated means to access or scrape the Site without our permission
- Submit false or fraudulent order information
- Post false, defamatory, harassing, or abusive content in reviews, the contact form, or anywhere else on the Site
- Impersonate another person or falsely claim affiliation with Dead Cute Studio
- Post content that infringes someone else’s copyright, trademark, or other intellectual property rights
- Post spam, unrelated promotional content, or irrelevant links in a product review
- Upload or transmit any file, code, or content containing malware or other harmful software
We reserve the right to edit, refuse to post, or remove any review or other user-submitted content at our discretion, for any reason.
10. Limitation of Liability
Your statutory rights. If you are a consumer residing in British Columbia (or another jurisdiction with similar protections), nothing in these Terms excludes, limits, or modifies any statutory consumer rights or warranties that cannot be excluded by law, including rights under the BC Business Practices and Consumer Protection Act and the Sale of Goods Act. Nothing in this section is intended to, or does, limit your right to a defective or faulty product — see Section 6 (Guarantees) and Section 7 (Returns and Exchanges) for how we handle that.
Website use. To the fullest extent permitted by law, Dead Cute Studio is not liable for indirect or consequential damages arising from your use of the Site itself — including computer viruses, site downtime, or typographical/pricing errors on the Site.
Product issues. Our approach to defective, damaged, or incorrect products is set out in Section 6 (Guarantees) and Section 7 (Returns and Exchanges), rather than a liability cap — this section does not attempt to limit your legal rights regarding the products themselves.
11. Governing Law
These Terms are governed by the laws of the Province of British Columbia and the laws of Canada applicable therein, without regard to conflict of law principles.
12. Dispute Resolution
If you have a concern about your order or these Terms, please contact us first at hi@deadcutestudio.com or call +1 (604) 330-0703 — most issues can be resolved quickly and directly. If a dispute can’t be resolved informally, it will be subject to the exclusive jurisdiction of the courts of British Columbia.
13. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the Site after changes means you accept the updated Terms.
